Frequently Asked Questions
Gazumping is when the house seller accepts a higher price offer from another buyer after the initial offer has been accepted. Fortunately, we offer you an Anti-Gazumping Agreement that’s extensively researched and concisely written by our in-house solicitors.
Ask that the property be taken off the market. (Remember, you must get this in writing or it really is meaningless). If they know you're ready (i.e. you have a mortgage in principal and are serious) then the seller should agree to this.
Our ironclad Anti-Gazumping Contract (i.e. a ‘lock out’, ‘preliminary’ agreement or ‘exclusivity’ agreement) could be made at this stage.
The buyer and seller agree to sign an Anti-Gazumping Agreement. If during the specified time period the seller decides not to proceed with the sale, or becomes unable to sell the property, the seller will immediately give written notice to the buyer and the agreement will end, but the restrictions of the agreement will continue until the end of the time period.
Each possible reason should be pre-agreed (e.g. if problems are found with your survey, your legal documents or your local authority and title searches, you will be entirely covered by our simple and secure Anti-Gazumping Agreement and you will be able to close your contract at any point in time).
Everyone in the process of buying a house should protect their interests by using an Anti-Gazumping Agreement. Note that if your conveyancer doesn't like Anti-Gazumping Agreements then it might be an idea to look elsewhere for legal advice. Why not use us? We can provide the simplest, most complete and legally-binding Anti-Gazumping Agreement available in the UK.
Although the specific time limit is decided between the buyer and the seller of the property, an Anti-Gazumping Agreement usually lasts for 10 days. The time limit should start from when you receive the contract, not from when the offer is accepted.
